1. Introduction

This website (the "Site") is operated by Dunce Twice Ltd ("Dunce Twice," "we," "us," or "our"), a company registered in England and Wales. Throughout the Site, "we," "us," and "our" refer to Dunce Twice Ltd.

By accessing or using any part of the Site, placing an order, or otherwise engaging with our products or services (together, the "Services"), you agree to be bound by these Terms of Service ("Terms"), including any additional policies referenced or linked within them. These Terms apply to all users of the Site, including browsers, customers, and anyone submitting content to us.

Please read these Terms carefully. If you do not agree to them, you should not access or use the Site.

We may update these Terms from time to time by posting the revised version on this page (see "Changes to These Terms" below). Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

2. Eligibility

By using the Site or placing an order, you confirm that you are at least 18 years old, or that you have the permission of a parent or guardian to make a purchase. If you are under 18, please ensure a parent or guardian reviews these Terms and completes any purchase on your behalf where required.

3. Orders and Contract Formation

Placing an order through the Site is an offer by you to purchase the relevant product, not an acceptance by us. A contract between you and Dunce Twice is only formed once we send you an order confirmation email. Until that point, we are free to decline or cancel your order for any reason, including but not limited to product unavailability, suspected fraudulent activity, or pricing errors.

We reserve the right to refuse or cancel any order, limit the quantity purchased per person or household, or restrict orders that we reasonably believe are made by resellers, dealers, or distributors rather than individual customers. If we cancel or amend an order after payment has been taken, we will notify you and issue a full refund for the affected items.

4. Pricing and Payment

Prices are displayed on the Site in the currency associated with your selected market or region, which you can change at checkout. The currency you are ultimately charged in may depend on your payment method and payment processor, and may involve currency conversion outside our control.

We make reasonable efforts to ensure prices are accurate, but errors can occur. If we discover a pricing error on an order you have placed, we will contact you to confirm whether you wish to proceed at the correct price or cancel the order, and you will not be charged until you confirm. We reserve the right to change prices at any time without notice, though changes will not affect orders already confirmed.

Payment is processed securely through Shopify and its payment providers. We do not store your full payment card details.

5. Delivery

Orders are fulfilled through our third-party fulfilment partner. Estimated delivery times, shipping costs, and related information are set out on our Shipping page. We are not responsible for delays caused by circumstances outside our reasonable control, including customs processing or courier delays, but we will do our best to keep you informed of any known issues affecting your order.

6. Returns, Refunds, and Cancellations

Details of our returns and refund process, including applicable timeframes, are set out on our Returns page. Please refer to that page for how to request a return, exchange, or refund.

7. Faulty or Not-as-Described Goods

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015. If an item you receive is faulty, damaged, or significantly different from how it was described on the Site, you are entitled to a repair, replacement, or refund as appropriate, regardless of any timeframes set out in our standard returns policy. 8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, product designs, images, and video content, is owned by or licensed to Dunce Twice Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, copy, distribute, sell, or otherwise exploit any part of the Site or its content without our prior written permission.

If you submit comments, reviews, suggestions, or other content to us (whether requested or unsolicited), you grant us a non-exclusive, royalty-free, worldwide right to use, reproduce, edit, and publish that content in any medium. We are under no obligation to keep such submissions confidential, compensate you for them, or respond to them. You agree that anything you submit will not infringe any third party's rights and will not be unlawful, abusive, or otherwise objectionable.

9. Intellectual Property Complaints

We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright, trademark, or other intellectual property rights, please send a written notice to dunce@duncetwice.com including: (a) identification of the right and the work you believe has been infringed; (b) identification of the specific material on the Site you believe is infringing, and where it can be found; (c) your contact details; (d) a statement that you have a good faith belief that the use is not authorised by the rights owner, its agent, or the law; and (e) a statement, made in good faith, that the information you have provided is accurate and that you are the rights owner or authorised to act on their behalf.

On receiving a valid notice, we will review the claim and, where appropriate, remove or disable access to the relevant material. We may also remove content or restrict access without a formal notice where we reasonably believe it infringes a third party's rights. Please only use this process for genuine intellectual property complaints.

To the fullest extent permitted by law, Dunce Twice Ltd shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or purchase of our products, including loss of profits, data, or opportunity. Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the relevant order.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under English law, including your statutory rights as a consumer.

13. Indemnity

You agree to indemnify and hold Dunce Twice Ltd, its directors, and employees harmless from any claim or demand, including reasonable legal costs, arising from your breach of these Terms or your violation of any law or third-party right.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also be entitled to bring proceedings in your local courts.
